Terms and Conditions
Article 1 (Purpose)
This clause is established by the corporate entity ADAPT HK (e-commerce trader, hereinafter referred to as "the Company") for the purpose of providing relevant online services (hereinafter referred to as "the Services") on the Foodology online shopping website currently operated (hereinafter referred to as "the Shopping Website") to meet the needs of users. It is intended to ensure the rights, obligations, and responsibilities of the users.
※ "These terms and conditions shall be subject to necessary modifications if necessary, and must be applicable to e-commerce transactions using PC communication or wireless communication. "
Article 2 (Definition)
① In order to provide computer and other communication tools for users called "shopping network" to conduct electronic commerce transactions on the electronic platform, which is referred to as "property", and represent the operators of online shopping networks.
② "Users" who have connected to the "Shopping Network" in accordance with the terms of use are members and non-members who receive online services.
③ "Member" means that individuals provide personal information and log in as members on the "shopping website". After being connected, the "shopping website" obtains the data and continues to provide services to the user.
④ "Non-member" means a person who has not become a member but uses the "Shopping Network" service.
Article 3 (Statement, Explanation and Modification of Terms of Use)
① To make it easier for users to understand the terms and trademarks of "Shopping Network", the representative name, business address (including the address for handling customer complaints), telephone number, fax number, email address, business registration number, mail order number, and other personal information management responsibilities will be listed on the starting screen before the start of the "Shopping Network" service. The terms and conditions will also be displayed on a screen that users can access to view.
② Before the user agrees to the terms, "Shopping Network" should display the relevant content of please withdraw the contract, shipping responsibility, and refund conditions in the predetermined content, so that the user can understand and confirm the content on the screen.
③ "Shopping websites" shall not violate the "Consumer Protection Law in E-commerce", "Terms and Conditions Regulations Law", "Electronic Transactions Basic Law", "Electronic Signature Law", "Information and Communication Network Utilization Promotion Law", "Sales Promotion Law", "Consumer Protection Law", and other relevant laws. Within the scope of not violating the above-mentioned laws, certain modifications can be made to these terms.
④ "Shopping Network" needs to announce the application date and the reason for the modification on the website between 7 days and the effective date before the effective date when modifying the terms. However, if the change is detrimental to the users, a notice should be issued at least 30 days before the grace period. This is to ensure that users can clearly compare the content before and after the revision.
⑤ If the terms of the "shopping website" have been modified, the revised terms shall only apply to contracts signed after the application date, while the terms and conditions before the revision shall apply to contracts signed before that date. However, if users who have already signed contracts wish to apply the amended terms within the notice period of Article 3, they must obtain the consent of the "shopping website" to apply the amended terms.
⑥ For matters not specified in this agreement and the interpretation of this agreement, relevant laws and regulations on consumer protection in e-commerce transactions, laws governing the terms of the agreement, etc., will be implemented according to the relevant laws and regulations or business practices formulated by the Fair Trade Commission.
⑦ "Members" should always pay attention to whether there are any changes in the terms and conditions of the personal agreement or usage policy.
Article 4 (Service Provision and Change)
① "Shopping Network" will perform the following operations.
1. Provide information about goods or services and sign a purchase contract.
2. Delivery of goods or services for which a purchase contract has been signed.
3. Other tasks specified by other "Shopping Network"
② "Shopping website" can change the content of the goods or services to be provided in the contract in the event of sold-out items, changes in technical specifications, etc. In this case, detailed information and delivery dates of the designated changes to the goods or services should be announced immediately.
③ If "shopping website" changes the service content agreed with the user due to reasons such as out of stock or technical specification changes, it should immediately notify the reasons to the address that can be notified to the user.
④ "Shopping Network" should compensate users for damages suffered due to prior reasons. But without any intention or negligence on the part of "Shopping Network", this will not apply.
Article 5 (Service Suspension)
① If "Shopping Network" suffers maintenance, replacement or damage to computers and other communication equipment, "Shopping Network" has the right to immediately suspend service provision.
② If "Shopping Network" suspends the provision of services due to the first clause, it shall be responsible for compensating the losses of users and third parties. However, if "Shopping Network" has no intention or negligence, this will not apply.
③ If the service cannot be provided due to the conversion of business projects, the abandonment of business, or the merger between companies, the shopping website should notify the users and provide compensation in accordance with the provisions of Article 8 and the conditions specified by the "shopping website". However, if the "shopping website" has not yet notified the compensation standards and criteria, the "shopping website" should use the corresponding physical or cash value of the currency, such as mileage or reserves, to pay the users.
Article 6 (Membership)
① Users should apply for membership by filling in their membership information in accordance with the "Shopping Network" registration form and expressing their willingness to agree to these terms.
② According to the first terms of membership of "Shopping Network", please register as a member unless you meet any of the following requirements.
- If the applicant has previously lost membership qualification according to Article 7, paragraph (3) of this Agreement, but then he/she should accept that after three years of losing membership qualification according to Article 7, paragraph (3), he/she can be exempted from re-registration.
2..If there is any falsehood, omission or misleading information.
- If it is judged that the technology of "Shopping Network" hinders the login of other members.
③ The establishment date of the membership contract is the time of acceptance of the terms of the "Shopping Network".
④ If the member's registration information changes as stated in Article 15, paragraph (1), the member should immediately notify "Shopping Network" of the changes by email or other means.
Article 7 (Member withdrawal and loss of qualifications, etc.)
① Members can withdraw from membership at any time, and "Shopping Network" needs to handle withdrawal from membership immediately.
② If a member has one of the following reasons, "Shopping Network" may restrict or suspend membership.
- The application was registered with false information.
- If the member fails to pay the member debt related to the use of the "Shopping Network", such as when the goods purchased through the "Shopping Network" are not paid.
- Threaten the order of e-commerce transactions by interfering with others' use of the "Shopping Network" or stealing information.
- Use of the shopping mall is prohibited by law or this agreement, or violates public order and morals, etc.
③ After the "shopping website" restricts or terminates the membership, if the same behavior is repeated multiple times or the reason is not corrected within 30 days, the membership of the "shopping website" may be lost.
④ If you lose your membership qualification and destroy your membership registration on the "shopping website", you should notify the member and provide an explanation opportunity at least 30 days before the membership qualification is revoked.
⑤ Members should use the goods purchased on "Shopping Network" as end consumers. If members violate their obligations by selling to others for profit, "Shopping Network" has the right to cancel their membership and demand compensation.
Article 8 (Notification to Members)
① When "Shopping Network" needs to notify members, members can pre-fill in the designated email address that the member wants to be contacted through "Shopping Network".
② "Shopping Network" can post personal notices on the "Shopping Network" bulletin board for more than one week without notifying specific members. However, individual notifications should be given for matters that have a significant impact on members' own transactions.
Article 9 (Purchase Application)
"Shopping website" users can apply for shopping on the "shopping website" through the following or similar methods, but when applying for a purchase, the "shopping website" must clearly provide each of the following items. However, if you are a member, you can exclude the second to fourth items.
1. Search and selection of goods.
2. Enter your name, address, phone number, email address (or mobile phone number).
3. Confirm the contents of the terms and conditions, services related to the right to cancel the order, and contents related to cost burdens such as shipping costs, installation fees, etc.
4. A sign indicating your agreement to these terms listed above and confirming or rejecting any of the above (for example, by clicking the mouse).
5. Confirm the application for purchasing goods, etc., and agree to the confirmation of the shopping website.

Article 10 (Conclusion of Contract)
① "Shopping Network" does not accept purchase applications for Article 9 if the following conditions are met. However, when entering into a contract with a minor, it is necessary to notify the minor or their legal representative for consent. If consent is not obtained from the legal representative, the contract may be canceled.
- Whether there is any false, omitted or misleading information in the application.
- Minors purchase goods and services prohibited under the Youth Protection Act, such as tobacco and alcohol.
- Other purchase applications are admitted, but technology is severely hampered by "Shopping Network" technology.
② When you agree to the confirmation notice in Article 12(1) of the "Shopping Network", you are deemed to have agreed to enter into the contract.
③ ""Shopping Network"" acknowledges the information regarding the confirmation and sale of the user's purchase application, as well as the correction or cancellation of the user's purchase application.
Article 11 (Payment Method)
The payment for goods or services purchased on the "Shopping Network" can be made through any of the following methods. However, in addition to paying for the goods, the "Shopping Network" may also charge a handling fee.
1. Various bank transfers, such as telephone banking, online banking and mail banking.
2. Pay with various cards, such as prepaid cards, debit cards, credit cards, etc.
3. Online bankbook deposit.
4. Electronic money payment.
5. Payment upon delivery.
6. Reserves (points) paid through "Shopping Network", such as mileage.
7. Pay through the mall contract or approved gift certificate.
8. Payment by other electronic payment methods.
Article 12 (Notice of receipt confirmation, change and cancellation of purchase notification)
① If the user has purchase requirements, the “Shopping Network” shall notify the user of the receipt confirmation.
② Users who have received confirmation notifications can request changes and cancellations of purchase applications if the data instructions do not match. "Shopping Network" has the obligation to handle this before shipping. However, if you have already made payment, you must comply with Article 15.
Article 13 (Supply of Goods, etc.)
① "Shopping website" should be able to package and deliver the goods within 7 days from the date of order, unless there is another agreement between the user and the supplier regarding the supply time of the goods. However, if "Shopping website" has received full or partial payment, it should take action within two working days after receiving the full or partial payment, and at this time, the user must be given the right to check the supply process and the progress of the goods.
② "Shopping website" should deliver the goods within the specified deadline, according to the specified delivery method and the freight and shipping methods stated in parallel. If the "shopping website" exceeds the delivery deadline specified in the contract, it will bear any liability for compensation, unless it is proven that the "shopping website" did not act intentionally or negligently.
Article 14 (Refund)
"Shopping website" should immediately notify the user of the reason when the delivery or provision of goods is not possible due to reasons such as product shortage, and receive the goods in advance from the date of receipt of the payment. Refund or take necessary measures within 2 working days.
Article 15 (Cancellation of Subscription, etc.)
① Users who have signed a product purchase contract with "Shopping Network" can cancel the order within 7 days after receiving the receipt confirmation notice.
② After the user receives the goods, if the following terms apply, they are not allowed to return or exchange the goods.
- If the goods are lost or damaged due to the responsibility of the user (however, if the packaging is damaged in order to check the contents of the goods, the offer can be canceled).
- The value of goods, etc., is greatly reduced due to use or consumption by users.
- If the value of goods, etc. decreases significantly due to the passage of time.
- If the product can be copied with the same performance, the packaging of the original product will be damaged.
③ In the case of (2) to (4), if the mall does not specify a withdrawal of the advance restriction on ordering and the user does not take any action (such as providing trial products), the user can cancel the order without any restrictions.
④ Despite the provisions of paragraphs (1) and (2), if the content of the goods or the content of the label and advertisement is different, the user may withdraw the subscription within 3 months from the receipt of the goods or within 30 days after becoming aware of it.
Article 16 (Effectiveness of cancellation of subscription, etc.)
① If the goods are returned from the user, "Shopping Network" should return the paid goods within 3 working days. In this case, when "Shopping Network" delays the return of goods, the delayed payment will be calculated by multiplying the delayed interest rate determined and announced by the Fair Trade Commission during the delay period.
② When users pay for goods through credit cards or electronic currencies, "Shopping Network" should immediately suspend the company's goods payment or request cancellation.
③ In the case of a request for cancellation, the user shall bear the cost of returning the received goods. "Shopping website" cannot require users to be fined or compensated for cancellation. However, if the content of the goods is different from the displayed items, the content of the advertisement, or the content of the contract, and the cancellation is due to the discrepancy, the return cost shall be borne by the "shopping website".
④ When the user bears the shipping costs, the "shopping network" must clearly indicate who is responsible for the costs when canceling the order.
Article 17 (Personal Information Protection)
① "Shopping Network" must collect the minimum information required for users to fulfill the purchase contract when collecting and finalizing the purchase contract. The following items are required, while others are optional.
1. Name
2.Address
3. Telephone number
4. Hope account (member)
5. Password (membership)
6. Email address (or mobile phone number)
7. Gender and date of birth
② "Shopping Network" must obtain the user's consent when collecting personal information that can identify the user.
③ The personal information provided shall not be used for other purposes or provided to third parties without the user's consent. However, exceptions are as follows.
- When using a delivery service, please inform the shipper of the minimum user information required for delivery (name, address, phone number).
- Conducted in a form that does not identify specific individuals necessary for statistical, academic or market research.
- Payments are made when necessary based on transactions such as goods.
- Authentication when necessary to prevent theft.
- If unavoidable reasons are required by law or law.
④ If "shopping website" needs to obtain the user's consent based on the provisions of Article 2 and Article 3, the identity of the personnel responsible for the management of personal information (self, name and telephone number, other contact information), the purpose of collecting and using such information, and the terms of providing data to third parties (recipient, purpose of providing, and content of information to be provided), etc., in accordance with the provisions of Article 22, Paragraph 2 of the "Promotion of Information and Communication Network Utilization and Information Protection Act," it should be designated or notified in advance and give the user the right to view.
⑤ Users can request to access and correct the personal information owned by "Shopping Network" at any time, and "Shopping Network" has the obligation to take immediate measures. If you request to correct an error, "Shopping Network" will not use the personal information until the error is corrected.
⑥ "Shopping website" limits the number of administrators to protect personal information and minimize the number of administrators. Users are fully responsible for any losses caused by the loss, theft, leakage, or alteration of their personal information (including credit card and bank account information).
⑦ When the purpose of collecting or receiving personal information is achieved, "Shopping Network" or the third party from which the personal information was received will immediately destroy the personal information.
Article 18 (Obligations of “Shopping Network”)
① "Shopping website" shall not engage in any activities prohibited or violating public order and morality by law or this agreement, and shall make every effort to consistently and stably provide goods and services in accordance with the provisions of this agreement.
② "Shopping websites" should be equipped with a security system to protect users' personal information (including credit information), so that users can safely use internet services.
③ The mall is responsible for compensating users for any damage caused by unfair trademark advertising as stipulated in Article 3 of the Trademark Advertising Fairness Act.
④ "Shopping Network" will not send commercial emails for commercial purposes that you do not want
Article 19 (Obligations of Member ID and Password)
① Except for Article 17, members are responsible for managing their ID and password.
② Members shall not allow third parties to use their ID and password.
③ If a member discovers that their ID and password have been stolen or used by a third party, they should immediately notify "Shopping Network" and follow the instructions of "Shopping Network" to respond.
Article 20 (Obligations of Users)
Users are not allowed to perform the following operations.
- Registration of false information when applying or changing.
- Steal other people's information.
- Change the information posted on the mall.
- Transmit or publish information (computer programs, etc.) other than the information specified by the mall.
- Infringement of intellectual property rights, such as copyrights outside the "Shopping Network" or other third parties.
- Behavior that damages the reputation of "Shopping Network" or other third parties or damages "Business".
- Disclose or post obscene or violent information, videos, audios or other information that violates public morals in the shopping mall.
- Provide the "Shopping Network" ID and password to third parties.
- Sell the goods purchased on the "Shopping Network" to others for commercial purposes or entrust them to third parties.
Article 21 (Relationship between affiliated shopping websites and non-affiliated shopping websites)
① If the upper part "購物網" and the lower part "購物網" are connected by hyperlinks (for example, the target of the hyperlink includes text, images, and motion images), the former is called the connected "購物網" (website), and the latter is called the non-connected "購物網" (website).
② For any transactions conducted between users and goods provided by the "商城" through non-connected means, "购物网" bears no responsibility. Furthermore, when connecting to "购物网" and displaying the initial screen or pop-up screen of "购物网," the company also does not assume any transactional liability.
Article 22 (Copyright Use and Restrictions)
① The copyright and intellectual property rights of the works created by “Shopping Network” belong to “Shopping Network”.
② In the information obtained through the use of "Shopping Network", users should not use it for commercial purposes by copying, transmitting, publishing, distributing, broadcasting, or any other means without the prior consent of the intellectual property rights belonging to "Shopping Network".
③ According to the agreement, "Shopping Network" shall notify relevant users when using copyrights related to the user.
Article 23 (Dispute Settlement)
① The "Shopping Network" should formulate a damage compensation mechanism from time to time to compensate users for their fair opinions or complaints.
② "Shopping website" should first handle user complaints and feedback. However, if it is difficult to handle them in a timely manner, the reasons and processing schedule will be immediately notified to the users.
③ If there is an electronic commerce transaction dispute between the "shopping website" and the user, and there is a claim for damages, it may be necessary to mediate the dispute through a dispute mediation organization required by the Fair Trade Commission or the local court.
Article 24 (Rights and Applicable Laws)
① The litigation regarding electronic commerce transaction disputes between "shopping websites" and users should be based on the address provided by the user at the time of submission. If there is no address, it should be under the jurisdiction of the local court where the user resides. However, if the user's address or residence is unclear at the time of submission, or if the user is a foreign resident, he/she shall file a complaint with the competent court according to the Civil Procedure Law.
② Korean law applies to e-commerce litigation between "Shopping Network" and users.
Article 25 (Individual Clauses)
① This agreement is the basic agreement between "Shopping Network" and users for the use of services. The company may determine in advance which matters will apply to certain services if necessary (hereinafter referred to as "personal terms"). If you agree to these terms and use certain services, these terms and conditions shall prevail and these terms shall take effect.
② When necessary, the "Company" can set personal details (usage policies, etc.) related to the use of services and notify users through the website.
Article 26 (Membership and Losses)
① The membership of "Shopping Network" is applicable to individuals or companies determined according to the policies of "Shopping Network". The membership criteria are based on other regulations of the shopping center.
② If a member loses membership due to violation of regulations, "Shopping Network" may withdraw or terminate membership without the member's consent.
Article 27 (Acquisition and use of points)
① Points (miles) refer to the miles the company pays to members based on the standards set by the shopping mall or agreements with other members.
② Points can be used to purchase goods specified by the "shopping website", but cannot be refunded in cash. The use of points designated by the "shopping website" is based on the notices on the "points" bulletin board.
③ According to the operation policy of "shopping website", points may be allocated for each product and service, and the availability and distribution of points may vary.
④ The detailed payment methods such as points for payment through "Shopping Network" should be made in accordance with the operating policies of "Shopping Network". Any changes to the detailed policies will be announced by "Shopping Network".
Article 28 (Cancellation of Points)
① Withdrawing from membership will result in the loss of membership points, regardless of their balance, and cannot be transferred to other people.
② If there is evidence that a member has illegally obtained points, the "mall" may delete their points without prior notice and may also restrict their membership.
③ Points are valid until the end of the year in which they are paid. If points expire without being used, they can be automatically eliminated according to the policy.
④ When the points automatically disappear, "Shopping Network" will send an email to the member's registered email address. However, it is the member's responsibility not to receive this information because they provided incorrect information.
⑤ If a member has unfairly used points due to violations of rules or other reasons, "Shopping Network" can continue to make requests and return the points used by the member to the member.
Article 29 (Compliance matters for members)
① Members should abide by the usage rules set by the "Shopping Network".
② Members shall not provide or use their ID and password to third parties without the consent of the company.
③ Members should abide by the price policy of the "Shopping Network" and shall not sell the products of the "Shopping Network" for commercial purposes or entrust them to third parties.
④ Members shall not disclose the secrets of the "Shopping Network" obtained through transactions to third parties.
⑤ If a member intentionally or negligently causes damage to the "Shopping Network", the "Company" may require the member to cause damage.
Article 30 (Dormant Account)
① If a member does not use the "shopping network" within a certain period of time determined, the member should be regarded as a "dormant account" for smooth membership management, and the member's activities and the use of any points paid to the account should be restricted. However, if the member requests to exit the dormant account according to the procedures set by the "shopping network", the "shopping network" will reactivate the previous membership status and points.
② After a certain period of time as a "dormant account", the "company" can terminate the member's points in accordance with the provisions of Article 8 after notifying the member.
